Big Red BulbWhere Communities Map Christmas Displays Together

Terms of Service

Terms of Service

Effective Date: Thursday, October 15, 2026 5:00 PM EST Last Updated: Thursday, October 15, 2026 5:00 PM EST

Plain-English Summary

This summary is here to help you read the Terms. It is not a substitute for them, and the full Terms below control.

  • Big Red Bulb is a free map where communities list holiday light displays. We host the tools. Community founders run their own communities and contests.
  • Most displays are at private homes. Look from the street, obey traffic laws, don’t trespass, and be kind to neighbors. Displays may not be lit, open or as described.
  • Don’t list a home if the people who live there object. Residents can ask us to correct or remove a listing.
  • You own what you post. You give us permission to show it on Big Red Bulb and on our sister site, Tacky Light Tour, and to put it in share graphics, flyers and yard signs that other people download and post.
  • Contests are run by community founders, not by Big Red Bulb. Any prizes come from founders or sponsors. No purchase is ever necessary. Cheating gets votes voided and accounts suspended.
  • Disputes go to individual arbitration, not class actions, unless you opt out within 30 days (Section 21).

1. Acceptance of These Terms

These Terms of Service (“Terms“) are a binding agreement between you and Christmas Lights Near Me, LLC, a Georgia limited liability company doing business as Big Red Bulb (“Big Red Bulb,” “we,” “us,” or “our“). These Terms govern your access to and use of bigredbulb.com and any related features, emails and materials we provide (collectively, the “Services“).

By accessing or using the Services, or by creating an account, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

Please read Section 21 carefully. It contains an arbitration agreement and class-action waiver that affect your legal rights, and explains how to opt out.

2. Eligibility

You must be at least 13 years old to use the Services. If you are at least 13 but under the age of majority where you live, you may use the Services only with the involvement and supervision of a parent or legal guardian who has reviewed and agrees to these Terms on your behalf.

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13, consistent with the Children’s Online Privacy Protection Act (COPPA). If we learn that a child under 13 has created an account or given us personal information, we will delete that account and information. If you believe a child under 13 has done so, contact us at support@bigredbulb.com.

By using the Services you represent that you meet these requirements and have the legal capacity to agree to these Terms.

3. Accounts and Roles

3.1 Visitors and Accounts

You can browse maps and display pages and get directions without an account. Other features (joining a community, confirming a display, nominating, voting, adding or claiming displays, uploading photos or videos, rating, and managing email preferences) require an account. When you create an account you agree to:

  • Give accurate, current and complete information and keep it up to date.
  • Keep your password confidential. You are responsible for all activity under your account.
  • Keep only one account per person, unless we expressly allow otherwise.
  • Tell us promptly at support@bigredbulb.com if you suspect someone else is using your account.

3.2 Roles

The Services let users take on different roles. Each role is a set of tools, not a job, partnership or agency relationship with Big Red Bulb.

  • Members. Any registered user can join a community with one click. Membership does not give you any power to edit the community or its displays.
  • Founders. A founder creates and manages a community (name, logo, description, season dates and area), approves ambassadors, runs contests, assigns awards, and may hide displays from the community’s list.
  • Ambassadors. Ambassadors are volunteers, approved by a founder, who add displays and confirm whether displays are lit.
  • Decorators. A decorator runs a display. Decorators may list or claim a display, add photos, videos, hours, season dates and features, and enter contests.

Founders and ambassadors are not our employees, agents or representatives, and they do not speak for Big Red Bulb. They are volunteers using our tools. We may grant, limit or remove any role at any time, including founder status for a community, if we believe it is needed to protect users, residents or the Services.

3.3 Claiming a Display

Only the person who runs a display, or someone that person has authorized, may claim it. We may ask for reasonable proof before approving or keeping a claim, and we may transfer or remove a claim if there is a dispute.

4. Acceptable Use

You agree not to:

  • Break any law or violate anyone’s rights.
  • Post content that is unlawful, defamatory, harassing, hateful, threatening, obscene, sexually explicit, or that promotes violence or illegal activity.
  • Post personal information about others beyond what is needed to identify a display (for example, residents’ names, phone numbers, license plates, or anything that identifies children), unless the person has agreed.
  • List a home whose occupant has told you, us or a founder that they do not want it listed, or list a property that is not decorated for public viewing.
  • Impersonate any person or business, or misrepresent your connection to a display, community, sponsor or contest.
  • Upload content you don’t have the rights to, including photos taken by someone else and business logos you aren’t authorized to use.
  • Submit false information, including fake displays, false “Seen it” confirmations, or misleading hours, features or charity claims.
  • Manipulate votes, ratings or rankings (see Section 9.6).
  • Use the Services to send spam or unsolicited advertising, or to promote a business except as a contest sponsor arranged through a founder.
  • Collect email addresses or other personal information from the Services.
  • Scrape, crawl or copy the Services or its listings by automated means, except search engines that follow our robots.txt.
  • Access accounts or systems without permission, probe or bypass security, overload the Services, or introduce malware.
  • Reverse engineer the Services except where the law expressly allows it.

We are not required to monitor the Services, but we may, and we may act on any violation at our discretion.

5. Displays at Private Homes

5.1 What a Listing Means

Most displays on Big Red Bulb are at private homes. Display pages may show a street address, a map location, photos, videos, hours and directions. Listings are added by decorators, ambassadors, founders and other users. A listing does not mean that the resident or property owner is affiliated with Big Red Bulb, endorses it, or agreed to be listed, unless the decorator has claimed the display.

5.2 Rules for Listing a Home You Don’t Own

You may add a display at a home you don’t own only if it is visibly decorated for public viewing from a public street or sidewalk. You must not:

  • List the home if the occupant has objected.
  • Include photos taken from private property or that show the inside of a home.
  • Include information that reveals more about the residents than is needed to find and enjoy the display.

5.3 Residents’ Requests to Correct or Remove a Listing

If you live at or own a listed property, you can ask us to correct, hide or remove the listing (including photos and address details) by contacting us through our Support page or at support@bigredbulb.com. We may ask for reasonable information to confirm your connection to the property. We will act on legitimate requests within a reasonable time, and once a home is removed at a resident’s request, users may not relist it.

Removal from the Services cannot recall copies of share graphics, flyers or signs that others already downloaded, printed or posted elsewhere (see Section 10).

5.4 Visiting Displays

You visit displays at your own risk. Displays are private property and are usually in residential neighborhoods. When visiting, you agree to:

  • Obey all traffic, parking and pedestrian laws. Do not use the Services in a way that distracts you while driving.
  • Stay on public streets and sidewalks. Do not trespass, touch decorations, or enter yards or driveways unless the decorator clearly invites visitors.
  • Not block driveways, mailboxes, fire hydrants or traffic.
  • Respect residents and neighbors: keep noise down, don’t litter, and follow any posted hours or instructions.

Features such as drive-through routes, FM radio music, Santa mailboxes or donation boxes are provided by decorators, not us. We don’t verify charity or donation claims; give only if you trust the decorator and the cause.

5.5 No Guarantee About Displays

We do not inspect displays. We do not guarantee that any display is lit, open, safe, accessible, lawful, accurately described or still there, or that directions are correct. “Seen it” confirmations, hours and features are reported by users and may be wrong or out of date.

6. Your Content

6.1 What Counts as User Content

“User Content” means anything you submit to the Services, including display listings, addresses and locations, photos, videos, descriptions, hours, features, community names, logos and descriptions, sponsor names and logos, award names, ratings, reviews, nominations, “Seen it” confirmations and claims.

6.2 You Keep Ownership

You keep whatever ownership rights you have in your User Content.

6.3 License You Give Us

So that we can run the Services, you grant Christmas Lights Near Me, LLC a worldwide, non-exclusive, royalty-free, fully paid, transferable and sublicensable license to host, store, reproduce, adapt, modify, crop, resize, translate, publish, publicly display, publicly perform, distribute and create derivative works of your User Content, in any medium now known or later developed, in order to:

  • (a) operate, display, improve and promote the Services;
  • (b) publish and synchronize your User Content on our sister site, tackylighttour.com, and its related apps and services (see Section 11);
  • (c) combine your User Content (including photos you upload of displays) with other content, such as display names, community names, award names and sponsor logos, in share graphics, flyers, yard signs and similar materials that we generate and that other users can download, print and share on other websites, social networks and in print (see Section 10); and
  • (d) allow other users to view, download, print and share your User Content as part of those materials and as the features of the Services allow.

The right to sublicense covers our service providers, the operator of tackylighttour.com, and other users as needed for items (b) through (d).

How long the license lasts. The license continues while your User Content is on the Services. If you or we remove User Content, the license ends for future use on the Services within a reasonable time, except that it continues: (i) for copies in backups kept for a limited period; (ii) for share graphics, flyers, signs or other materials that were already downloaded, printed or shared before removal, which we cannot recall; (iii) for content other users have already incorporated, such as a community page or contest results; and (iv) as needed to keep records of votes already counted, comply with law, or resolve disputes.

To the extent the law allows, you waive any “moral rights” or similar rights in your User Content that would prevent the uses described above, such as rights to attribution or to object to cropping or combination with other content.

6.4 Your Promises About User Content

When you submit User Content, you promise that:

  • You own it or have all permissions needed to post it and to grant the license above, including for sublicensing and use in materials others download.
  • If it shows identifiable people, you have their permission (and a parent’s permission for any child).
  • If it is a sponsor’s name or logo, you are authorized by the sponsor to use it as described in these Terms.
  • It is accurate and doesn’t violate anyone’s copyright, trademark, privacy, publicity or other rights, or these Terms.

6.5 Our Rights Over Content

We may, but don’t have to, review, edit, refuse, hide or remove any User Content, at any time and for any reason, including in response to resident requests, legal complaints or violations of these Terms. We don’t endorse User Content, and the views in it belong to the person who posted it.

7. Ratings and Reviews

Ratings and reviews must reflect your honest, first-hand experience of the display. You may not:

  • Post a rating or review in exchange for payment, prizes or other benefits without clearly disclosing it.
  • Rate or review a display you run, or that a family member or business connection runs.
  • Post fake reviews, reviews on behalf of someone else, or reviews meant to hurt a competing display in a contest.
  • Include content that breaks Section 4.

Requesting removal of a review. Anyone, including the decorator, can ask us to review a rating or review using the request process on the Services or at support@bigredbulb.com. We will remove reviews that break these Terms or the law. We will not remove a review just because it is negative. We may tell the reviewer that their review was removed.

8. Communities and Founders

8.1 Founder Responsibilities

If you create or run a community, you agree to:

  • Run it fairly and lawfully, and follow these Terms.
  • Use only names, logos and images you have the right to use. A community name or logo must not suggest that the community is an official government, HOA, school or business group unless you are authorized to represent that group.
  • Accurately describe the community’s area and season dates.
  • Approve ambassadors in good faith, and remove them if they misuse their role.
  • Pass along residents’ removal or correction requests to us promptly, and never relist a home removed at a resident’s request.

8.2 Hiding Displays

Founders may hide displays from their community’s list. Hiding a display removes it from that community’s view but does not necessarily remove it from the Services. Founders must not use this tool to discriminate against decorators on the basis of race, religion, national origin, sex, disability or other protected characteristics, or to retaliate unfairly in a contest.

8.3 Our Role

We provide the tools. We are not responsible for how a founder runs a community. We may edit, merge, transfer or remove communities, and change or remove founder status, if we believe it is needed.

9. Contests and Awards

9.1 Big Red Bulb Is a Platform, Not the Contest Sponsor

Community founders may use the Services to run decorating contests (“Contests“) in their community. Each Contest is organized by its founder (the “Organizer”), not by Big Red Bulb. Unless we clearly state otherwise for a specific Contest, Big Red Bulb is not a sponsor, promoter, administrator, judge or prize provider for any Contest, and we do not award prizes. Our role is limited to providing software that records entries, collects votes and displays a leaderboard.

9.2 No Purchase Necessary

No purchase or payment of any kind is ever necessary to enter, vote in or win a Contest, and a purchase will not improve anyone’s chances. Big Red Bulb does not charge to use the Services. Organizers must not charge entry or voting fees through or in connection with the Services.

9.3 How Contests Work on the Services

  • An Organizer creates awards (categories) for a Contest and may give an award a sponsor’s name and logo.
  • Each decorator enters their display in one award so that votes aren’t split across categories. The decorator’s choice locks when voting opens, but the Organizer can still change which award a display is entered in, including after voting opens.
  • Voting is open to signed-in users, or the Organizer may restrict voting to the community’s ambassadors.
  • The leaderboard shows standings publicly and may change as votes come in.
  • Organizers may also assign awards to entries directly.
  • Voting limits and dates are shown on the Contest’s pages.

9.4 Organizer Responsibilities

If you run a Contest, you are solely responsible for it, including:

  • Writing and publishing clear official rules (eligibility, dates, how winners are chosen, prizes and their value, how prizes are delivered, and how you handle ties and disputes), and following them.
  • Complying with all laws that apply to your Contest, including state and local laws on contests, sweepstakes and promotions, any registration or bonding requirements, and rules about entries by minors.
  • Providing any prize you or a sponsor promised, and handling any taxes, tax reporting and prize paperwork.
  • Making sure you have written permission from each sponsor to use its name and logo, and that the sponsor agrees to its name and logo appearing on the Services, the leaderboard, share graphics, flyers and yard signs.
  • Making clear to entrants and voters that you, not Big Red Bulb, are running the Contest.
  • Using a decorator’s email address, if they chose to share it with you, only to run that Contest (for example winner news, prize pickup and sign delivery). You must not add it to a mailing list, give it to a sponsor or anyone else, sell it, or use it for anything else. We may remove founder status from anyone who misuses shared contact details.

9.5 Prizes

Any prizes come from Organizers or their sponsors, not from Big Red Bulb. We do not guarantee that any prize will be awarded, delivered or as described, and any claim about a prize is between you and the Organizer or sponsor. Unless stated otherwise for a particular Contest, awards are for recognition only.

9.6 Fair Play

To keep Contests fair, you may not:

  • Create or use more than one account, fake accounts, or other people’s accounts to vote.
  • Use bots, scripts, or other automated means to vote or create accounts.
  • Buy, sell, trade or offer anything of value for votes, or join vote-swapping schemes.
  • Pressure, threaten or mislead anyone to get votes.
  • Otherwise interfere with the fair operation of a Contest.

We may, at our discretion and without notice, void votes, reset counts, remove or disqualify entries, change leaderboards, and suspend or terminate accounts that we reasonably believe are involved in cheating, whether or not the account holder personally did it. We may share information about suspected cheating with the Organizer.

9.7 No Guarantee of Results

We try to count votes accurately, but we do not guarantee that vote counts, leaderboards or results are error-free, complete or uninterrupted. Votes may be lost, delayed or adjusted because of technical problems, fraud prevention or corrections. The Organizer decides the official results of its Contest. To the fullest extent permitted by law, Big Red Bulb is not responsible for any Contest’s outcome or any dispute about it.

10. Share Graphics, Flyers and Yard Signs

10.1 What We Generate

The Services generate share graphics (for example, for Facebook, Instagram, Nextdoor, X and text messages), printable flyers, and printable yard signs with QR codes that link to a display’s ballot (“Generated Materials“). Generated Materials combine display names, community names, award names, sponsor names and logos, and photos uploaded by users, including photos uploaded by other users of displays in the same community.

10.2 Your License to Use Generated Materials

Subject to these Terms, we give you a limited, non-exclusive, non-transferable, royalty-free, revocable license to download, print, post and share Generated Materials only to promote the related display, community or Contest. You may not:

  • Sell Generated Materials or use them to advertise a business (other than a sponsor’s name and logo as they already appear).
  • Alter them in a way that is misleading, removes or changes a sponsor’s logo or other credits, or suggests endorsement by Big Red Bulb, a sponsor, a decorator or a resident that doesn’t exist.
  • Use them after we ask you to stop, for example because a resident or rights holder has objected.

Logos, photos and other content in Generated Materials belong to their owners. This license does not transfer any ownership.

10.3 Your Responsibilities When Sharing or Posting

You are responsible for following the rules of any site where you post Generated Materials (for example, social network terms and community guidelines), and for following all local sign ordinances, right-of-way rules, HOA rules and property owners’ wishes when placing flyers or yard signs. Only place signs where you have permission.

10.4 Removal

If content is removed from the Services, we will stop including it in newly generated materials within a reasonable time, but we cannot recall copies already downloaded, printed or shared.

11. Sister Site: Tacky Light Tour

Big Red Bulb and tackylighttour.com (“Tacky Light Tour”) are operated by the same company. Display listings and related content are shared and synchronized between the two sites, so content you submit on Big Red Bulb may appear on Tacky Light Tour and its apps, and content submitted on Tacky Light Tour may appear here. Usage counts that are not tied to your name or account, such as display views and saves, may be combined across both sites. See Section 6 of our Privacy Policy for details on how information is shared. Your use of Tacky Light Tour is governed by its own terms.

12. Email

We send the following kinds of email:

  • Essential account email, such as account verification and reminders to verify your account (up to four over 30 days), password resets, and important notices about your account or these Terms. You can’t opt out of these while you have an account.
  • Contest email, such as a welcome email the first time each season that your display is entered in a Contest, and “voting is open” reminders you choose to receive.
  • Announcements, such as occasional updates to founders and decorators about tools and features.

You can turn off announcements at any time on your email preferences page or by using the unsubscribe link in the email. Contest email is sent only because of something you or the Organizer did, such as entering your display or asking for a reminder. If mail to your address bounces or you mark it as spam, we may stop sending optional email to it. See Section 9 of our Privacy Policy.

13. Shop

Big Red Bulb merchandise is sold through Redbubble, an independent third party. When you buy from the shop, you are buying from Redbubble under its own terms and privacy policy, and Redbubble handles payment, production, shipping, returns and customer service. We do not take payments on bigredbulb.com.

14. Our Intellectual Property

14.1 Our Content

Except for User Content and third-party content, the Services and everything in them, including the site design, text, graphics, logos, software, map styling, Generated Material templates and the compilation of listings, are owned by Christmas Lights Near Me, LLC or its licensors and protected by intellectual property laws.

14.2 Trademarks

“Big Red Bulb,” the Big Red Bulb logo, and our other marks are trademarks of Christmas Lights Near Me, LLC. You may use them only as they appear in Generated Materials, or with our prior written permission. Other names and logos on the Services, including sponsor logos, belong to their owners.

14.3 Your License to Use the Services

Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes and, for founders and decorators, to run communities, displays and Contests as these Terms allow.

14.4 Copyright Complaints (DMCA)

If you believe content on the Services infringes your copyright, send our designated agent a notice that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and where it is on the Services (a URL is best); (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the copyright owner.

Designated Copyright Agent: Christmas Lights Near Me, LLC 8735 Dunwoody Place, Ste R, Atlanta, GA 30350 Email: support@bigredbulb.com

If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice with the information required by 17 U.S.C. § 512(g). We terminate the accounts of repeat infringers in appropriate circumstances.

15. Third-Party Services and Links

The Services use and link to third-party services, including maps (Leaflet, with map tiles from Esri and data from OpenStreetMap contributors), directions apps, social networks, video sites (such as YouTube, Facebook and Vimeo) and the FromSmash upload service, Google ads, Redbubble, and links that decorators and founders add. Our Privacy Policy lists the providers that receive personal information. We don’t control these services and aren’t responsible for their content, accuracy, availability or practices. Your use of them is governed by their own terms and privacy policies. Map data and directions may be inaccurate; always follow road signs and conditions.

16. Feedback

If you send us ideas, suggestions or feedback, you agree we may use them freely, without restriction or payment to you.

17. Disclaimers

THE SERVICES AND GENERATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties arising from course of dealing or usage of trade.

Without limiting the above, we do not warrant that:

  • Any display is lit, open, safe, accessible, lawful or as described, or that addresses, maps or directions are accurate.
  • User Content, including listings, photos, ratings, reviews and “Seen it” confirmations, is accurate or reliable.
  • Any Contest will be run fairly or lawfully by its Organizer, that vote counts or leaderboards are accurate, or that any prize will be awarded.
  • Generated Materials comply with the rules of any website, sign ordinance, HOA or property owner.
  • The Services will be uninterrupted, secure or error-free.

We are not responsible for the conduct of any user, founder, ambassador, decorator, sponsor, resident or visitor, online or offline.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHRISTMAS LIGHTS NEAR ME, LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE OR DATA, ARISING OUT OF OR RELATING TO THE SERVICES, ANY DISPLAY, ANY CONTEST, ANY GENERATED MATERIALS, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some places don’t allow some of these exclusions or limits. Where that is the case, they apply to the fullest extent the law allows. Nothing in these Terms limits liability that cannot be limited by law.

19. Indemnification

You agree to defend, indemnify and hold harmless Christmas Lights Near Me, LLC and its members, managers, officers, employees, contractors, agents, licensors and suppliers from all claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • (a) your use of the Services or your visits to displays;
  • (b) your User Content;
  • (c) any Contest you organize, including its rules, prizes, taxes, legal compliance and any sponsor arrangements;
  • (d) any sponsor name or logo, or other third-party material, you submit;
  • (e) your use, posting or placement of Generated Materials, including flyers and yard signs;
  • (f) your violation of these Terms; or
  • (g) your violation of any law or the rights of any third party, including residents and rights holders.

We may take control of the defense of any claim at our own expense, and you will cooperate with us.

20. Suspension, Termination and Account Closure

By us. We may suspend or end your access to all or part of the Services, remove any role, or delete your account, at any time, with or without notice, including if we believe you have broken these Terms or created risk for other users, residents or us.

By you. You can stop using the Services at any time. To close your account, contact us through our Support page or at support@bigredbulb.com.

What happens to your content. Closing your account does not necessarily delete everything associated with it. Displays you added or claimed, photos, community pages, Contest entries and votes already counted may remain on the Services and on Tacky Light Tour, and the license in Section 6.3 continues as described there. Some information may be kept as described in our Privacy Policy.

Survival. Sections that by their nature should survive termination will survive, including Sections 5.4, 5.5, 6.3 to 6.5, 9.4 to 9.7, 10.2 to 10.4, 14, 16 to 22, and 24.

21. Dispute Resolution: Please Read Carefully

21.1 Informal Resolution First

Before filing any claim, you agree to try to resolve the dispute informally by emailing support@bigredbulb.com with a description of the dispute and the relief you want, and giving us at least 60 days to respond. We will do the same before filing a claim against you.

21.2 Binding Individual Arbitration

Any dispute, claim or controversy between you and Christmas Lights Near Me, LLC arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding, individual arbitration administered by under its then-current consumer arbitration rules. The Federal Arbitration Act governs this Section. The arbitrator decides all issues, except that a court decides questions about the scope, validity or enforceability of the class-action waiver in Section 21.3. Arbitration will take place in Fulton County, Georgia, or, at your choice, by video, telephone or written submissions. Payment of arbitration fees will be governed by the administrator’s consumer rules. Judgment on the award may be entered in any court with jurisdiction.

21.3 Class-Action Waiver

YOU AND CHRISTMAS LIGHTS NEAR ME, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. The arbitrator may not combine more than one person’s claims or preside over any representative proceeding. If this class-action waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court under Section 22, not in arbitration.

21.4 Small-Claims Court

Either party may bring an individual claim in small-claims court instead of arbitration if it qualifies.

21.5 Exceptions

Either party may ask a court for injunctive or other equitable relief to protect its intellectual property rights or to stop unauthorized access to or misuse of the Services.

21.6 Your Right to Opt Out

You may opt out of this arbitration agreement and class-action waiver by sending notice to support@bigredbulb.com, or by mail to Christmas Lights Near Me, LLC, 8735 Dunwoody Place, Ste R, Atlanta, GA 30350, within 30 days of first agreeing to these Terms. The notice must include your name, the email address on your account (if any), and a clear statement that you want to opt out of arbitration. Opting out will not affect any other part of these Terms.

22. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Georgia and applicable U.S. federal law, without regard to conflict-of-laws rules. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia.

23. Changes to These Terms

We may change these Terms from time to time. When we do, we will update the “Last Updated” date. If a change is material, we will give reasonable advance notice, for example by a notice on the Services or an email to registered users. Changes apply going forward and will not apply to disputes we already knew about before the change. Your continued use of the Services after a change takes effect means you accept the updated Terms.

24. Miscellaneous

  • Entire Agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Services.
  • Severability. If any part of these Terms is unenforceable, the rest stays in effect.
  • No Waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not transfer these Terms without our written consent. We may transfer them, including in a merger, acquisition or sale of assets.
  • No Agency. These Terms do not create any agency, partnership, joint venture or employment relationship, including between us and any founder, ambassador, decorator or sponsor.
  • Notices. We may give you notices by email to your account address or by posting on the Services. You may give us notices at the contact details below.
  • Headings and Summary. Headings and the Plain-English Summary are for convenience only and do not affect how these Terms are interpreted.
